Here listed are the terms and conditions (T&Cs) for White Side Holidays Poland Ltd. 39 Headlands Drive, Hessle, East Yorkshire, HU13 0JP. Hereafter referred to as “White Side Holidays Poland Ltd”.
1. Agreement
1.1 The terms and conditions of this document together with your booking form comprise the agreement between White Side Holidays Poland Ltd and all those listed on the ski holiday booking form, on whose behalf the group leader has signed. The contract is deemed to have been made as soon as the signed booking confirmation form is received by White Side Holidays Poland Ltd.
1.2 The group leader is responsible, on behalf of all other members of the group, for all matters relating to the booking, thus he/she will be personally liable for all monies outstanding from the remainder of the guests.
1.3 “The group” refers to all persons listed on the booking form and also includes any subsequent changes of names to the original booking.
1.4 If at any time, prior to the start of the holiday, there is a change of group leader then White Side Holidays Poland Ltd must be notified, either by email or telephone, by the original group leader and a new booking confirmation and terms and conditions form must be signed by the new group leader and returned to White Side Holidays Poland Ltd before embarking on the holiday.
2. Bookings
2.1 Once availability has been confirmed, by White Side Holidays Poland Ltd a booking enquiry will be held for 7 working days, pending receipt of the appropriate deposit (50% of the full holiday price or relevant amount shown with special offers) and the completed booking form.
2.2 Thereafter the booking will be deemed cancelled if no deposit is received and White Side Holidays Poland Ltd reserves the right to re-book the selected holiday without notification.
2.3 The total amount outstanding on your holiday must be paid 8 weeks prior to your departure from the UK (unless otherwise stated in email communications between White Side Holidays Poland LTD and the group leader). For bookings made within this period the full cost of the holiday will be payable at the time of booking (unless otherwise stated in email communications between White Side Holidays Poland LTD and the group leader).
2.4 If the final balance is not received 8 weeks prior to the day the holiday commences (unless otherwise stated in email communications between White Side Holidays Poland LTD and the group leader) White Side Holidays Poland Ltd reserve the right to cancel the booking and any deposits paid will be forfeited (every effort will be made to contact the client to remind them of payment dates). White Side Holidays Poland Ltd then reserves the right to re-book the chosen holiday.
3. Alterations to the booking
3.1 If you wish to alter the booking after the contract is formed, we will do our best to arrange this. An amendment fee of £30 per person will be made for each detail of the booking changed.
4. Cancellation by you
4.1 All changes and cancellations to your ski holiday booking must be made in writing or by email and received by White Side Holidays Poland LTD before the departure date.
4.2. Your deposit payment is non refundable (unless otherwise stated in email communications between White Side Holidays Poland LTD and the group leader).
4.3 After full payment has been received by White Side Holidays Poland LTD any refunds following cancellation of a holiday by the group leader will be given as follows: More than 12 weeks before the holiday start date a refund of 75% of your total payment will be given (unless accommodation choice is a 3,4 or 5* hotel in which case this will be 60%). From 12 – 6 weeks the refund amount will be 40% and within 4 weeks of the holiday start date no refund will be given.
5. Price variations by White Side Holidays Poland Ltd
5.1 Whilst we reserve the right to change our prices from time to time, your confirmation invoice price will not change.
6. Holiday Insurance
6.1 Skiing and snowboarding can be a dangerous pursuit both on and off piste, White Side Holidays Poland Ltd will endeavour to make your trip as safe as possible, but not all risks, dangers and hazards can be anticipated or avoided. Therefore you MUST be insured for the entire duration of your stay which covers you for cancellation, curtailment and winter sports including mountain rescue and repatriation.
7. Alterations to your holiday by White Side Holidays Poland Ltd
7.1 Arrangements to your holiday as described in these Booking Conditions are made many months in advance. We reserve the right to make any such necessary changes. Most will be very minor and we will notify you of any major changes. In the event of a major change you have a choice: A) accept the change B) purchase another holiday from us C) cancel your holiday.
8. Cancellation by White Side Holidays Poland Ltd
8.1 We reserve the right in any circumstances to cancel your holiday, and to return all money you have paid to us, or offer you an alternative holiday to purchase. However, in no case will we cancel your holiday less than 8 weeks before departure, except for reasons outside our control including, but not limited to reasons of Force Majeure.
9. White Side Holidays Poland Ltd liability
9.1 White Side Holidays Poland Ltd does not accept any liability wheresoever or howsoever arising, or pay compensation for:
Any event which White Side Holidays Poland Ltd could not foresee or avoid, amounting to Force Majeure (Force Majeure meaning war, political unrest, weather, strikes, acts of God, epidemics, riots, civil strife, industrial disputes, terrorist activity, natural or technical disasters, nuclear war)
Any cancellation, loss, delay or costs wheresoever or howsoever arising or connected with adverse weather or traffic conditions, avalanche, mud slips, slides and snow conditions and the effect any of these may have on travel arrangements, accommodation and activities.
Limitations imposed by resort authorities, ski-lifts, ski school or ski hire operators.
Travel arrangements made by the group or on behalf of the group.
Any personal injury, illness or death wheresoever or howsoever arising caused to any visitor and/or any member of the group for their duration of stay. This is not intended to exclude any statutory rights the group and/or visitor may have. This agreement and any proceedings there under are to be governed by English Jurisdiction.
9.2 A person who is not a party to this Contract has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Contract provided always this does not affect any right or remedy of a third party which exists or is available apart from this Act.
10. The responsibility of White Side Holidays Poland Ltd
10.1 The manager, representative and/or supplier at White Side Holidays Poland Ltd organises our ski/ snowboard program with your safety in mind. They have complete discretion to vary or cancel any aspect of our snow sports programme such as mountain escorting or lessons according to weather conditions and the experience of the group members.
11. If you have a complaint
11.1 We do try to ensure your holiday with us is as enjoyable as possible. If you have a complaint please: a) whilst on holiday. Immediately inform the manager, who will try to put things right quickly. B) On your return home. Within 28 days follow up your complaint by writing to our UK office.
12. Brochure Information accuracy
12.1 The Booking Conditions have been prepared from advance information. Whilst every care is taken that this information is correct at time of going to press it has to be remembered that facilities may be withdrawn from White Side Holidays Poland Ltd holiday particulars as a result. Whilst every effort is made to ensure that all information is correct, White Side Holidays Poland Ltd cannot be held responsible if this should prove inaccurate.
13. Special requests
13.1 If you have any special requests that are not covered by the holidays described in our website or these Booking Conditions please let us know. We will try to meet such requests but cannot guarantee to do so.
14. Valid passports are required for visitors to Poland
14.1 Visas are NOT required for EU citizens. Non EU citizens may require a visa and should enquire at the Polish Embassy.
15. Flights
15.1 You are responsible for booking your own flights. White Side Holidays Poland Ltd will assist you in finding suitable flights if you so desire. White Side Holidays Poland Ltd accepts no responsibility for problems with your flights. All problems or complaints about flights should be dealt with directly with your chosen carrier.
15.2 White Side Holidays Poland Ltd will make every effort to ensure your timely arrival at the airport for your return flight, however, we can not be held responsible for unforeseen circumstances leading to missed departures.
16. Ski and Snowboard hire
16.1 Damage or loss to hired ski/snowboard equipment is entirely your own responsibility and White Side Holidays Poland Ltd will not be liable for any charges incurred. All payments for damage, loss or renewal must be paid to either White Side Holidays Poland Ltd or the rental shop by you before departure.
17. Responsibilities, behaviour and property damage
17.1 If a guests behaviour is adjudged by the manager and or staff of White Side Holidays Poland Ltd as antisocial and also detrimental to other guests staying in the same accommodation or have a negative effect on the reputation of White Side Holidays Poland Ltd, the manager reserves the right to terminate their holiday on grounds of antisocial behaviour with no refund to their loss of holiday.
17.2 If a guest damages any property inside their holiday accommodation or any property of White Side Holidays Poland Ltd. The person/s involved will have to pay the full recommended retail price for the damaged goods and items. Failure to pay will result in appropriate legal action and the cancellation of your group’s holiday.
18. Law and Jurisdiction
18.1 Your contract with White Side Holidays Poland Ltd is governed by English law and in the event of any dispute is subject to the exclusive jurisdiction of the English courts.
